General Terms and Conditions (AGB)

of Simple Smile GmbH, Zurich Seefeld

Status: Zurich, March 2025

1st area of application

These GTC apply to all contractual relationships between you and Simple Smile GmbH, Bellerivestrasse 28, 8008 Zurich (hereinafter referred to as "Simple Smile/Journey of the Smile" or "we"). By concluding a contract with Simple Smile/Journey of the Smile, these GTC become an integral part of the agreement.

 

2. services of Simple Smile/Journey of the Smile

Simple Smile/Journey of the Smile provides dental and dental hygiene services and related products and ancillary products as described in the patient information and consent form. Our service is aimed at private individuals residing in Switzerland.

 

Our offers are available to persons aged 18 and over who are capable of judgment. For under 18s, treatment with aligners and additional products is only possible with the written consent of a legal representative. We recommend that a legal representative is present at all appointments. Treatments with veneers and bleachings are excluded for minors.

 

By agreeing to these GTC, you confirm that these conditions are met.

3. prices and terms of payment

Our prices and conditions will be communicated to you in our offer when you request a treatment plan or order products and/or additional products. This offer is valid for one month ("acceptance period"). If the acceptance period has expired, you will receive a new offer with the current prices and conditions, which will again be valid for one month.

 

The prices stated on our website or in brochures are non-binding and do not constitute a binding offer.

Payment of the costs must be made in full before the start of treatment. You are responsible for any fees or other transaction costs incurred for transfers to our account. Payment is made in Swiss francs (CHF).

 

Alternatively, we offer payment on account via a third-party provider, which also enables payment by installments. By selecting this payment method, you agree to the forwarding of the data required for invoicing and collection. Additional fees and interest may apply. The third-party provider is solely responsible for all questions regarding invoicing. If you have any complaints about payment processing, please contact the third-party provider directly. If you do not pay your installments on time, we are entitled to suspend our services.

 

The order is considered successfully completed as soon as we have received the offer signed by you and the full payment has been received by us. In the case of payment on account with installment facility, the conditions of the credit check must be met and the corresponding agreements signed.
 

4 Obligations of the customer to cooperate

  • You undertake to act in good faith and in particular:

  • to provide complete and truthful information about your person, health and physical condition,

  • provide us with your current contact information,

  • to be solvent when ordering our products, to follow our instructions when using our services, to provide only such information and documents that you are authorized to pass on.

In the event of a breach of these obligations, we are entitled to refuse our services and to invoice the costs incurred as a result. 

5. warranty

We will replace defective products and additional products free of charge within two (2) years of the first application. If the products are collected from our practices or delivered by Simple Smile/Journey of the Smile, the warranty period begins with the collection or delivery. A product is deemed to be defective if its suitability is significantly impaired due to errors in its manufacture or use by Simple Smile/Journey of the Smile.

 

Warranty claims are excluded if the defect was caused by the customer's own fault, in particular by breach of the obligation to cooperate or improper handling of the products. Damage caused by accidents, non-compliance with the dentist's instructions or other factors not attributable to the manufacture and insertion by Simple Smile/Journey of the Smile are also excluded from the warranty. Simple Smile/Journey of the Smile shall decide at its own discretion whether a warranty case exists.
 

6. patient information

Please note that we cannot guarantee the success of our treatments, as each person responds individually to the therapy. During your appointments, we will inform you about how you should use and care for the products and additional products as well as about possible risks. You will find detailed information on this in the patient information and the declaration of consent. Please read these documents carefully.
 

7 Cancellation conditions / "No Show"

Cancellations and changes to appointments must be communicated at least 24 hours before the scheduled appointment by telephone or e-mail to the respective Simple Smile/Journey of the Smile practice. The contact details of the various practices can be found on our website. In the event of no-shows or last-minute cancellations (less than 24 hours before the appointment), we will charge a "no-show fee" of CHF 100.
 

8. limitation of liability

All dental treatments at Simple Smile/Journey of the Smile are carried out according to the current state of medical science. Despite the greatest care, we cannot guarantee success, especially not for a specific treatment result. You agree that we are not obliged to restore your original dental situation, to offer alternative treatment or to cover the costs if you are dissatisfied with the treatment result.

 

You will be informed about possible risks and side effects in the patient information, the declaration of consent and in a personal consultation with the treating dentist. The dentist's instructions must be strictly followed, including the rules of conduct during treatment. Failure to do so will invalidate any claim to corrections, follow-up treatment or warranty.

 

The liability of Simple Smile/Journey of the Smile and its auxiliary persons is limited to gross negligence and willful misconduct. Any further liability is excluded to the extent permitted by law.
 

9. data protection

Our privacy policy informs you about how we process and protect your personal data. By using our services, you agree to this.

10. completeness of the contract

These GTC, the documents you sign when ordering, the patient information, the declaration of consent and the privacy policy govern all rights and obligations of the parties in connection with the services provided by us. Any deviating arrangements or agreements between the parties are invalid and have no legal validity.

11. waiver of rights

If one party fails to comply with one part of the contract and the other party does not insist on proper performance, this shall not be deemed a waiver of the right to performance of other parts of the contract.

Severability clause

Should a provision of these GTC be invalid or ineffective, the validity of the remaining provisions shall remain unaffected. The invalid or ineffective provision shall be replaced by a provision that best reflects the original intention of the parties and, if possible, achieves the same economic result.

12. changes to the GTC

We reserve the right to amend these GTC at any time. You will be informed of the changes in a suitable form. If you do not object to the changes in writing within one (1) month of notification, they shall be deemed to have been accepted. The current version of the GTC can be viewed on our website.

Applicable law and place of jurisdiction

Swiss law shall apply to all claims in connection with the services provided by us. The exclusive place of jurisdiction for all disputes is Zurich.
